General Terms and Condition

These General Terms and Conditions of Service (also referred to as “Terms”) apply to, and are incorporated into, all agreements agreed with GoDutchers, all GoDutchers’ offers and quotations and deliveries and services provided by Simplicity London LTD.

All copyright, trademarks, database right and other intellectual property rights in the Content are owned by GoDutchers or its licensors. Indemnity

You are responsible to GoDutchers for all losses, liabilities, costs and expenses, reasonably suffered or incurred by GoDutchers under any judgment by a court of competent jurisdiction and all settlement sums paid by GoDutchers because of:

•any claim by a third party that your use of the Site is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

• any claim by any third party that your use of the Site infringes that third party’s copyright or other intellectual property rights of whatever nature;

• any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with your use of the Site.

No Warrantie

The Site is provided by GoDutchers without any warranties. GoDutchers (to the fullest extent allowed by law) disclaims all warranties, conditions or duties of every nature, including (without limitation) any implied warranties of satisfactory quality or fitness for a particular purpose, any express or statutory warranties and any warranties or duties regarding accuracy, timeliness, completeness or performance. GoDutchers makes no warranty that the services rendered by the members of the network will be performed in accordance with the expectations of the clients. GoDutchers makes no warranty that the Site is free from infection by viruses, Trojan horses or worms or anything else that has contaminating or destructive properties.

Liability

You agree that GoDutchers can not be held responsible for the execution of the services rendered by members of the network. Users of GoDutchers are liable for their own proceedings and the, whether or not, decent fulfillment of those proceedings. You agree that (to the fullest extent allowed by law) GoDutchers will not be liable to you and/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site. The Site may contain materials posted by others. Users are responsible for ensuring they comply with the General Terms and Conditions GoDutchers. GoDutchers will not be responsible to you for any breach of General Terms and Conditions GoDutchers by another user. If GoDutchers is liable for damages to persons or property, or if in the course of an assignment an event occurs that could lead to any liability on the part of GoDutchers, such liability is limited to the amount that is paid out in that specific case under the insurance of GoDutchers, increased by the amount of the applicable deductible (eigen risico).

Restriction

You may not use the Site to;

• disseminate any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;

Any personal information you provide to GoDutchers through the Site will be used in accordance with the GoDutchers Privacy Policy.The GoDutchers Privacy Policy does not apply to any third party website accessible via hyperlinks from the Site.

General

Disputes shall be settled exclusively by the court that has jurisdiction in London. For the exclusive benefit of GoDutchers, GoDutchers retains the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or your principal place of business. If any court of competent jurisdiction finds any provision of general terms and conditions of GoDutchers invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall remain in effect. Failure by GoDutchers to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. GoDutchers shall not be responsible for any breach of general terms and conditions of GoDutchers caused by circumstances beyond its control.
